Annexation dispute panel to meet December 17

A three-person panel will meet on Monday, December 17 at 1:30 pm, Conference Room B at the Gwinnett Justice and Administration Center, for the next step in the process of resolving the disputed annexation of the tract at the corner of Rosebud Road and Brushy Fork Road.

The panel will consist of one representative from the city, one from the county and a planning professional.  I am the county’s representative on the panel.

The panel’s recommendation will be part of the facts presented on January 28 when the Snellville City Council is expected to make a final decision on the annexation and the proposed rezoning to allow the construction of a daycare center.

City Council Rejects Garmon Drive R-HOP

The Snellville City Council voted unanimously on Monday evening to deny an application by Genesis Development Group to annex and rezone 42.8 acres to R-HOP(55)-SF, Single-Family Residential Housing (Detached) for Older Persons District for an active-adult/senior-oriented residential development comprised of 149 lots.

Even though the city’s planning staff has recommended that this proposal be denied, the Council’s vote came as a surprise, especially since both Council member Barbara Bender, an adjoining property owner, and newly-elected Tod Warner, a former Planning Commissioner, had recused themselves from the vote.

The Council voted to deny the application “without prejudice,” which means that the one-year waiting period to file anew is waived. Because the proposal was an assemblage of properties with apparently cooperative and willing owners, it is highly likely that another rezoning application will be filed. Given the County Commission’s objection to the density of the project and the community’s stiff opposition, however, a second attempt will be much less dense.

With the disposition of this case, the holiday schedule for the Rosebud Coalition has suddenly cleared!

Tomorrow (Tuesday) night, the applicant on the Rosebud/78 annexation and rezoning will formally withdraw his proposal before the Planning Commission in the hopes of resubmitting early next year.

The proposal of a daycare center at the corner of Rosebud Road and Brushy Fork Road is on the City Council’s January 28 agenda. Before that date, a three-person citizen panel should meet to review the annexation, which has been disputed by the county. I have been appointed to represent the county on that panel; no meetings have yet been scheduled.

Upcoming Development Issues

The December Gwinnett Planning Commission preliminary agenda contains two development proposals in the area; both are on Midway Drive at Lake Carlton Drive and by the same owner/applicant. John Hall proposes to build 57 single-family units at R-60, one of the highest single-family densities available, on 17 acres. (Case #s: RZR-07-043 & 044)

Danny Herrmann of Diversified Development has applied for a Change In Conditions on two commercial rezonings approved earlier this year on Midway Drive at Palmer Drive and Lake Carlton Road. Herrmann hopes to reduce a buffer that made the construction of certain buildings impractical. The cases are on the January 2008 Planning Commission agenda. (Case #s: CIC-2008-00001 & 00002)

Rosebud/78 Rezoning to be Withdrawn

According to the applicant, the city planning staff is requiring that the application for annexation and rezoning of the tract at Hwy. 78 and Rosebud Road be resubmitted, as opposed to allowing him to split the present application and proceed on November 27. As a consequence, the earliest that a new rezoning proposal can appear on the Planning Commission’s agenda is February, 2008. Read more…

Church proposal out; retail to be heard November 27

Earlier today, I sent an email to the applicant and city planning staff regarding the proposed shopping center and religious campus at the intersection of Rosebud Road and Hwy. 78. In it, I expressed my disappointment in the developer’s failure to communicate with the community regarding a recently-conducted traffic impact study and the resulting revisions to the plan.

The email prompted an immediate response from the applicant, Danny Herrmann. According to Herrmann, the developer of the proposed church/ministry has failed to provide assurance of adequate financing. For that reason, Herrmann has today asked city planners for permission to withdraw his application for rezoning for the southernmost portion and continue with the annexation and rezoning for the retail part.

According to Herrmann, the concerns regarding traffic flow on Rosebud Road will be addressed by long-awaited intersection improvements by the state and county which are scheduled to begin in 2008.
