Rosebud Daycare on 9/24 Council Agenda
You may recall that we were told last month by the Chairman of the Planning Commission that ANX 07-09 LUP 07-11 RZ 07-17, the annexation and rezoning for a daycare center at the corner of Rosebud Road and Brushy Fork Road, had been scheduled for a January 28 hearing before the City Council. However, I learned late on Friday afternoon that the case is on the Council agenda for a possible second reading and final decision on Monday night (7:30 pm, City Hall).
This is extremely disconcerting; not only because we had been given a different date but because it eliminates any possibility that the community could meet with the applicant to influence the development of this tract. In addition, the applicant substantially changed his proposal at the Planning Commission meeting. We planned to use the additional time to review the applicant’s revised plan, if and when he made it available.
On Friday afternoon, I emailed the acting Planning Director and copied the City Clerk and the City Council to express my concern and ask for an explanation. I have yet to receive a response, probably because it was sent close to the end of business on Friday.
One reason to believe that the scheduling of the case for Monday may be in error is the fact that this annexation has been disputed by the County and is currently going through the new dispute resolution process. The fact that the annexation is in dispute was confirmed as recently as Thursday morning by a county Assistant Attorney.
I will work to get clarification on Monday and will notify the group as soon as I have an answer. It may be necessary, however, for those interested in this particular case to attend the Monday night Council session.
Update 9/24 AM: An email from the city planning department acknowledged that the case is in dispute resolution and will most likely be tabled at tonight’s meeting until the dispute is resolved.
